As per the report of Wall Street Journal, in order to improve the chances of getting success in the H-1B Visa lottery, the immigration lawyers were engaging themselves in filing the multiple applications for the same individual. The USCIS has stated that, it has received nearing to 233,000 applications for the H-1B visas on April 7, 2015. This means that, application has only 36% chance to be considered further. Out of the visa application to be considered further by the USCIS, many have been refused. In an attempt to overcome the low chances of success for a single visa petition, companies in the USA are lodging multiple H-1B visa applications for Individual candidates.
What Is Unknown Is, Number of Duplicate Applications for H-1B Visa
To employ the same individual, it is not known, out of 233,000 lodged applications how many of them are multiple application. The Attorney, are of the view that the numbers could easily run in thousands.
An Excerpt from the Wall Street Journal report read that, immigration lawyers were involved in helping the companies to circumvent H-1B restrictions state that, were offering support by filing the multiple H-1B skilled visa application for the same individual. Few workers are considering the offers from the numerous employers, each of whom would lodge a petition on behalf, lawyers say.
Multiple H-1b Visa Petitions Are Not Illegal
The lawyers involved in the process of filing the multiple H-1B visa are not considered to be illegal and it has been continuing for years without gaining much attraction. This is becoming more common now as the economy strengthens and the competition to obtain an H-1B visa in order to become more intense.
The smaller businesses state that this process is underhand and it puts them at disadvantage because they are unable to afford to lodge the multiple visa applications. The wall street journal have reported that immigration lawyers are charging anywhere between $2000 to $4000 to file an H-1B visa petition on behalf of their clients.
Multiple Applications Are Made and It Is Not Surprise
Elizabeth Hyman (Executive Vice President of advocacy for CompTIA- an IT industry group), it is not really a surprise that the practice of lodging the multiple H-1B visa applications or that the system is the way, it is today. It is lottery based on the chance as opposed to the system which is ration and addresses the needs of the US companies.
She also added, that companies are using every legal avenue possible to meet the employment needs of their business. After all, it no secret that the companies are struggling in order to fill their vacant, high skilled job roles and H-1B lottery system which does very little to remedy this.

The US H1B visa is a non immigrant visa which allows the US companies to employ the foreign workers having minimum bachelor’s degree in speciality occupations in fields including IT, accountancy, mathematics, science and medicine. Under this visa, the US company can employ foreign worker on H-1B visa for a period of up to 6 years.
